p.s. Maybe one of you fine gentlemen can search your entire /usr/share directory(learn C+ while your at it --you may have to use that to fix it) and post back with your detailed results.
LOL Wow pch that was a bit harsh, but none the less I got tough skin and took your insight and found out how to change it, it may not be the way it should be done but it worked for what people have been asking for so without further ado the way I disabled Tux was by running the following code:

sudo gedit /usr/share/icons/default/index.theme
